Judicial review declarations
High Court instructions require a disciplined focus on the decision under challenge, the pleaded grounds, and the evidence capable of assisting the Court. Expert declarations can explain country material, foreign procedure, or systemic conditions where those matters are necessary to determine legality, fairness, or risk.
Court of Appeal evidence
For appellate proceedings, the scope is carefully framed around the issues permitted by the Court. A declaration identifies the expert's qualifications, materials considered, methodology, factual assumptions, and any matters that cannot responsibly be concluded.
Duty to the Court
Expert evidence is independent and candid about qualifications and limitations. It is prepared in accordance with CPR Part 35 and PD 35 where applicable, with the overriding duty owed to the Court rather than to the party funding the instruction.
